Terms & Conditions
These Terms govern your use of the ALTEMARE platform and every charter booked through it. By using the platform you agree to be bound by them, so please read them before booking.

1. Definitions
- Platform — the ALTEMARE website and booking services operated by ALTEMARE.
- Charterer / you — the person or entity booking a Charter through the Platform.
- Operator — the independent yacht owner or management company that supplies the Yacht and performs the Charter.
- Charter — the hire of a Yacht for the agreed period, together with any crew and Additional Services.
- Charter Agreement — the contract for the Charter between you and the Operator, generated and signed digitally during booking.
- APA (Advance Provisioning Allowance) — a fund, typically 25–35% of the charter fee on crewed charters, paid in advance to cover fuel, food, beverages, berthing, and other running expenses. Unspent APA is returned to you after the Charter.
- Security Deposit — a refundable amount held against loss or damage on applicable Charters, released after the Yacht is returned in good order.
- Force Majeure — events beyond reasonable control, including severe weather rendering the Charter unsafe, natural disasters, pandemics, war, terrorism, and governmental or port authority action.
2. Our role as a marketplace
ALTEMARE is a booking platform, not the owner or operator of the yachts listed. The Charter itself is performed by the Operator under the Charter Agreement between you and the Operator. We facilitate discovery, booking, digital contracting, and payment, and we vet Operators before they may list — but the Operator remains responsible for the Yacht, its crew, and the performance of the Charter.
Listing details (specifications, amenities, photographs, availability) are supplied by Operators. We require them to be accurate and act on reports that they are not, but we cannot guarantee every detail.
3. Accounts and eligibility
- You must be at least 18 years old and have full legal capacity to book a Charter.
- You must provide accurate account and passenger information and keep your credentials secure; you are responsible for activity under your account.
- We may suspend or close accounts used fraudulently, unlawfully, or in breach of these Terms.
4. Booking and payment
4.1 Booking process
A booking is made by selecting dates, any Additional Services, and the charter party, signing the Charter Agreement digitally, and paying the amount stated at checkout. Instant Book listings are confirmed immediately on payment; request-to-book listings are confirmed when the Operator accepts, and any payment is released or returned accordingly.
4.2 Pricing
The price shown at checkout itemises the charter fee, APA where applicable, taxes (such as VAT, which varies by cruising area), delivery or relocation fees, and any Additional Services. Prices displayed in other currencies are indicative conversions; the charge is made in the currency stated at checkout.
4.3 Payment
Payments are processed securely by Stripe. Depending on the listing, you pay either the full amount or a deposit at booking, with the balance due by the date shown at checkout and in your booking summary. Failure to pay a balance when due may be treated as a cancellation under clause 6.
4.4 APA and Security Deposit
Where the listing specifies an APA or Security Deposit, the amounts and handling are stated in the Charter Agreement. Unspent APA is accounted for and returned after the Charter; the Security Deposit is released after the Yacht is returned in good order, less any agreed deductions for loss or damage.
5. The charter
- The charter party may not exceed the guest capacity in the listing; the Yacht may be used only for private pleasure purposes, not for cargo, commercial activity, or re-hire.
- On crewed Charters the captain has final authority on all matters of safety, navigation, and itinerary, including declining to sail in unsafe conditions. Following the captain's lawful instructions is a condition of the Charter.
- On bareboat Charters you must hold the licences and demonstrate the competence required by the Operator and the flag or coastal state before departure.
- You are responsible for the conduct of your charter party, for complying with local laws (including customs and immigration), and for loss or damage caused by your party beyond fair wear and tear.
- Itineraries are indicative and subject to weather, safety, and port-authority constraints.
6. Cancellations and refunds
6.1 Cancellation by you
Each listing displays its cancellation policy tier before you book — Flexible, Moderate, or Strict — with the refund ladder (what percentage of the charter fee is refundable at each point before departure). The policy shown on your booking at the time of confirmation is the one that applies. APA and Security Deposits are always refunded in full on cancellation; card processing fees may be non-refundable.
6.2 Cancellation by the Operator or us
If the Operator cancels, or the Yacht becomes unavailable and no comparable substitute is agreed with you, you receive a full refund of all amounts paid. We may additionally assist in finding an alternative Yacht, but are not obliged to cover any price difference.
6.3 Force Majeure
Where a Force Majeure event prevents the Charter, the Charter Agreement governs the outcome; unless it says otherwise, amounts paid for the unperformed part of the Charter are refunded or re-credited. Weather that is merely unpleasant, as opposed to unsafe in the captain's judgment, is not Force Majeure.
6.4 Changes
Date or itinerary changes after confirmation require the Operator's agreement and may carry a price adjustment. We will tell you the cost of a requested change before you commit to it.
7. Insurance and safety
Operators are required to hold hull and third-party liability insurance appropriate to the Yacht and its cruising area, and to comply with the safety and manning requirements of their flag state and, where applicable, coastal-state codes (such as MCA coding for UK-flagged commercial yachts). Personal travel, medical, and cancellation insurance for your charter party is your responsibility and is strongly recommended.
8. Acceptable use of the platform
- No scraping, harvesting, or reproducing listings or content by automated means.
- No circumventing the Platform — soliciting or accepting a booking generated through ALTEMARE outside the Platform to avoid fees is a breach of these Terms.
- No unlawful, fraudulent, or abusive use; no impersonation; no uploading of malicious code; no attempts to gain unauthorised access.
- Reviews and other content you post must be genuine and lawful; we may remove content that is not. You grant us a licence to display content you post on the Platform.
9. Liability
Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or fraud.
Subject to that: the Charter is performed by the Operator, and claims arising from the performance of the Charter lie under the Charter Agreement. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, and our aggregate liability to you in connection with the Platform is limited to the total fees paid by you through the Platform in the 12 months before the event giving rise to the claim.
You agree to indemnify us against losses arising from your breach of these Terms or violation of applicable law or third-party rights.
10. General
- Privacy — our Privacy & Cookie Policy forms part of these Terms.
- Intellectual property — the Platform and its content belong to us or our licensors; you may use them only to browse and book Charters.
- Changes to these Terms — we may update these Terms; the version in force when you book governs that booking. Continued use of the Platform after an update constitutes acceptance for future bookings.
- Severability — if any provision is held invalid, the remainder stays in force.
- Entire agreement — these Terms, the Charter Agreement, and the Privacy Policy are the entire agreement between you and us regarding the Platform.
11. Governing law and disputes
The governing law and forum for these Terms are being finalised and will be published here before public launch. Nothing in this document limits the mandatory consumer protections of your country of residence.
Each Charter Agreement you sign states its own governing law and forum for disputes about that charter, and is the controlling document for it.

ALTEMARE's registered company details and governing-law jurisdiction are being finalised and will be published in this document before public launch. Every charter you book is additionally governed by the Charter Agreement you sign, which names the operator, the yacht and the terms of that specific charter.
